A BUYER'S ADVOCATE
What is the difference to a general real estate agent and a Buyer's Advocate (or Agent)?
- A buyer's advocate acts for the buyer
- A real estate agent acts for the seller
Are they licensed?
- YES. All persons negotiating property contracts in Queensland and all Australian states must hold the appropriate Real Estate Licence.
- In Queensland, The Property Agents and Motor Dealers Act (PAMD) covers dealings within the real estate industry and is administered by the Office of Fair Trading
Can an agent be both?
- In Queensland an agent is appointed via a PAMD Form 22a which states the agent may only act for one party, the buyer or the seller, therefore an agent cannot act for both parties in the same transaction.
- In Victoria and NSW similar laws apply and, when in doubt, we suggest you obtain written confirmation from your agent detailing exactly what you want them to do on your behalf
Why use a Buyer’s Advocate?
- As a general agent is appointed by the seller, it is the agent’s responsibility to achieve the highest possible price for the seller.
- Queensland contract law is based on “Buyer Beware”
- As a buyer, you are endeavouring to secure the property at the lowest possible price and on terms suitable to you
- A Buyer’s Advocate is someone who knows the real estate business and has access to all the tools a selling agent has. However, we use our knowledge to act in the best interest of YOU, the buyer
- Our primary goal is to locate, investigate and negotiate to secure your home or investment property at the right price for YOU, the buyer
